The Trainer stated that the rider followed the instructions but only rounding the final bend when he went for the gap in front, the gap got closed and he had to shift out and later desparately rode out but lost the race in a very narrow margin. I. The Stewards examined trainer Mr. Irfan Ghatala and Jockey Anjar Alam. After due examination, they directed the Stipendiary Stewards to issue appropriate Charge Sheet to Jockey Anjar Alam and Trainer Mr. Irfan Ghatala.
Accordingly the following Charge Sheets were issued to Jockey Anjar Alam and Trainer Mr. Irfan Ghatala as detailed below:
Charge Sheet to Jockey Anjar Alam:
II. "Contravention of Rule No.159(b) of the BTC Rules of Racing in that as the rider of HILLFIGER in the above said race (a) you did not make effort to improve your position till rounding the final bend; (b) you allowed your mount to travel wide from 650 Metres till about entering the straight; and (c) you did not ride out your mount vigorously passing the 400 Metres and thus you have contravened Rule No.159(b) of the BTC Rules of Racing reading as follows:
"The rider of every horse shall take all reasonable and permissible measures throughout the race to ensure that, his horse is given full opportunity to win or to obtain the best possible place in the field".
Charge Sheet to Trainer Mr. Irfan Ghatala:
III. Contravention of Rule Nos.114(b)(i) & 159(a) of the BTC Rules of
Racing in that as the Trainer of HILLFIGER in the above said race:
(a) You, on your own admission submitted that the horse HILLFIGER requires good handling and needs to be ridden hard with the aid of whip, you declared Jockey Anjar Alam admittedly knowing his capabilities and also knowing that he is not entitled to use whip in races. Thus there has been neglect in the discharge of your duties as a trainer vide Rule 114(b)(i) of BTC Rules of Racing.
(b) When the rider has not taken all reasonable and permissible measures throughout the race to ensure that his mount is given full opportunity to win or to obtain the best possible place in the field, you on your own never submitted before the authorities the above facts but on the contrary were attempting to defend the action of Jockey Anjar Alam while examined by the Stipendiary Stewards and the Stewards. Thus it is evident that the rider has ridden your charge HILLFIGER in such a manner with the tacit approval of you
(c) The above amounts to your not running your charge HILLFIGER on merits thereby contravening Rule 159(a) of the BTC Rules of Racing reading as follows: "Every horse shall be run on its merits whether his owner runs another horse in the race or not".
IV. The Stewards in the light of the above charge sheet issued examined Mr. C.A. V. In view of the above Jockey Anjar Alam was guilty of contravening Rule No.159(b) of the BTC Rules of Racing.
VI. In the light of the above, the Stewards decided to withdraw the Jockey's licence granted to Jockey Anjar Alam with effect from 16-7-2012 to 15-12-2012 (both days inclusive) for contravention of Rule No.159(b) of the BTC Rules of Racing in connection with his riding on his mount HILLFIGER in Race No.95 of the Bangalore Summer Meeting 2012 on 23-6-2012 .

(b) When the rider has not taken all reasonable and permissible measures throughout the race to ensure that his mount is given full opportunity to win or to obtain the best possible place in the field, he on his own never submitted before the authorities the above facts but on the contrary was attempting to defend the action of Jockey Anjar Alam while examined by the Stipendiary Stewards and the Stewards. Thus it is evident that the rider has ridden his charge HILLFIGER in such a manner with the tacit approval of him.
(c) The above amounts to his not running his charge HILLFIGER on merits thereby contravening Rule 159(a) of the BTC Rules of Racing reading as follows: "Every horse shall be run on its merits whether his owner runs another horse in the race or not".
